Ms. Tremain joined Kilgore Law in 2011. Her practice is focused on employment law. She has worked on over 50 lawsuits and similar matters for which no lawsuit was filed. Most of her efforts deal with employment discrimination and retaliation. She also works on cases involving termination for refusal to perform an illegal act, interference with FMLA (Family and Medical Leave Act) rights, retaliation for taking FMLA leave, retaliation for claiming Worker's Compensation benefits, employment contracts and agreements, wage and benefit denials, defamation or slander, fraud and misrepresentation cases, unfair competition and non-compete agreements. In addition, she works on trade secret and trademark disputes.
The favorable outcomes Ms. Tremain has achieved are many. For example, she has:
- Obtained a six-figure settlement for an employee of a large company who was terminated because of age.
- As co-counsel, obtained a six-figure settlement for an employee of another large company who was terminated because FMLA leave was taken.
- Three months after filing suit, obtained a favorable settlement for an employee who was denied rights
under FMLA. - Succeeded in getting dismissed on summary judgment a discrimination lawsuit that was filed
against a non-profit. - As co-counsel, obtained a $368,000 jury verdict on a lawsuit involving multiple cross-claims between an employer and a former employee.
- As co-counsel, prevailed in a jury trial for an employee who took FMLA leave.
- Obtained a favorable settlement for an employee who was terminated because of a disability.
- Recovered unpaid commissions owed to a former employee of a sales company.
- As co-counsel, obtained a favorable settlement for an employee who was terminated because he complained about racial slurs and race-based harassment in the workplace.
- As co-counsel, obtained a favorable settlement for an employee of a foodservice company who was fired because she refused to participate in fraudulent accounting practices.
She has argued in the district courts of Dallas, Collin, Denton and Hunt Counties; the county courts of Dallas County and the Federal District Courts in Dallas. She has tried cases in the Dallas County district courts and the Dallas County federal courts. Further, she has participated in appeals to the 8th Circuit Federal Court of Appeals and the Texas Court of Appeals Fifth District.
