In Texas, employers have the option to not subscribe to Texas workers’ compensation. Employers who offer to their employees a substitute form of worker’s compensation insurance are called nonsubscribers. Nonsubscribers lose some legal protections and are subject to special rules concerning employer liability.

Kilgore & Kilgore handles work injury claims involving nonsubscriber employers. Our decades of experience, versatility and persistence achieve measureable results for our clients. If you have a nonsubscriber personal injury claim, don’t settle for less than you deserve. You may be able to recover damages for injuries, pain and suffering related to those injuries, mental anguish, impairment, disfigurement, medical expenses and lost earnings.

ERISA Disability Claims

Some worker injury claims are also governed by a federal law called the Employee Retirement Income Security Act (ERISA), under plans adopted as alternatives to workers compensation coverage. These claims usually raise issues beyond a disability, such as the timeliness of notice of an injury and the appropriateness of medical expenses. These plans are oppressive in their one-sidedness and claims under them are often hard to pursue. When claims are successfully pursued, the benefits afforded are typically more limited than workers compensation benefits.

Arbitration Agreements Pose Problems for Claims for Injury

Some Texas courts have enforced arbitration agreements. Sometimes, it is best to not pursue such claims because of the nearly impossible hurdles to success. If you signed an arbitration agreement when you started your job, you are likely bound by that agreement. Our compensation claims lawyers have helped clients in arbitrations against their employers. We level the playing field and fight to ensure that arbitration leads to a fair result.
